RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2014-01876
COUNSEL: NONE
HEARING DESIRED: NO
APPLICANT REQUESTS THAT:
His orders for the period 4 Dec 13 to 22 Dec 13 and 23 Dec 13 to
16 May 14, be combined and his deployment orders for the period 23
Dec 13 to 10 Apr 14, be extended to 18 Apr 14, to allow him to
utilize all earned leave upon completion of the mobilization in
support of Operation ENDURING FREEDOM.
APPLICANT CONTENDS THAT:
His orders should have been extended to 18 Apr 14, and he should
have earned 14 days of leave.
The applicants complete submission, with attachments, is at
Exhibit A.
STATEMENT OF FACTS:
The applicant is currently serving in the Air National Guard (ANG)
in the grade of master sergeant (E7).
The applicant was mobilized under Title 10 United States Code
(U.S.C.), §12301, during the period 4 Dec 13 through 16 May 14.
The remaining relevant facts pertaining to this application are
described in the memorandum prepared by the Air Force office of
primary responsibility (OPR), which is included at Exhibit C.
AIR FORCE EVALUATION:
NGB/A1P recommends approval, indicating the applicants military
records should be corrected to reflect compensation of military
pay, points, and applicable benefits for 9 days (25 minus 16), by
updating the end date of tour from 10 Apr 14 to 19 Apr 14.
During the applicants orders for the period 4 Dec 13 through
22 Dec 13 and 23 Dec 13 through 10 Apr 14 and per AFI 36-3003,
Military Leave Program, he earned 11 days of Regular Leave. He
was granted 14 days of Post Deployment Stand-Down Time (PDSDT)
(maximum downtime) based on his 180 days deployed time-in-theater,
in accordance with Air Mobility Command policy.
The Deliberate and Crisis Action Planning and Execution System
(DCAPES) records showed the applicants original deployment time-
in-theater end date of 13 Apr 14. However, the actual end date,
in accordance with his filed travel voucher, was 24 Mar 14 21
days early. He arrived at home station on 25 Mar 14, in
accordance with the DCAPES record. The change in travel to his
home station resulted in a decrease days in the number of leave
days authorized for the period of duty. His 4 Dec 13 to 10 Apr 14
orders only afforded him 16 days to use 25 days of accrued PDSDT
(14 days) and Regular Leave (11 days).
A complete copy of the NGB/A1P is at Exhibit C.
APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant
on 11 Aug 15, for review and comment within 30 days (Exhibit D).
As of this date, no response has been received by this office.
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of an error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case
and agree with the opinion and recommendation of the Air Force OPR
and adopt its rationale as the basis for our conclusion the
applicant has been the victim of an error or injustice. We note
the applicants requests for his command man-day allocation system
pre-deployment and deployment orders to be combined and the
deployment orders for the period 23 December 2013 to 10 April
2014, be extended to 18 April 2014, to allow him to utilize earned
leave upon completion of the mobilization in support of Operation
ENDURING FREEDOM. However, the OPR recommends correction of the
records to update the end date of tour from 10 Apr 14 to
19 Apr 14, as opposed to the 18 Apr 14 end date of tour requested
by the applicant. We agree with their recommendation. The
recommendation affords the applicant 25 days to use a total of
fourteen PDSDT days and eleven regular leave days. Therefore, we
recommend the applicant's records be corrected as indicated below.
THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to the APPLICANT be corrected to show that he was not
released from active duty on 10 April 2014, but continued to serve
on active duty, in an ordinary leave status, until 19 April 2014.
